富島総業（株）は、令和６年２月19日の宮古島市における工事現場において、「足場の組立て等を請け負う１次下請け事業者であるが、高さが２メートル以上の構造の足場の組立ての作業を行わせるに当たり、足場材の緊結、取り外し、受渡し等の作業にあっては、墜落による労働者の危険を防止するため、要求性能墜落制止用器具を使用させる措置を講じなければならないにもかかわらず、これを講じなかった」として、労働安全衛生法違反により令和７年１月７日、平良簡易裁判所より罰金20万円（法人）、罰金10万円（個人）の略式命令を受け、その刑が確定した。 このことが、法第28条第１項第３号に該当すると認められる。
