① 貴社は、一次下請として請け負った高知県高岡郡四万十町におけるトンネル掘削工事において、令和４年３月１１日、休業４日以上の労働災害が発生したにもかかわらず、令和５年８月２３日に至るまで労働者死傷病報告書を所轄労働基準監督署長に提出しなかった。 この件について、遅滞なく法令の定める報告をしなかったとして、貴社及び貴社の従業員は、令和５年１２月２５日付けで労働安全衛生法違反により、須崎簡易裁判所からそれぞれ罰金刑の略式命令を受け、その刑が確定している。 このことが建設業法第２８条第１項第３号に該当すると認められる。 ② 貴社は、一次下請として請け負った山梨県南巨摩郡早川町におけるトンネル掘削工事において、令和５年４月１８日、休業４日以上の労働災害が発生したにもかかわらず、同年７月４日に至るまで労働者死傷病報告書を所轄労働基準監督署長に提出しなかった。 この件について、遅滞なく法令の定める報告をしなかったとして、貴社及び貴社の従業員は、令和６年３月２６日付けで労働安全衛生法違反により、鰍沢簡易裁判所からそれぞれ罰金刑の略式命令を受け、その刑が確定している。 このことが建設業法第２８条第１項第３号に該当すると認められる。
