被処分者は、不動産売買契約の買主から依頼を受けて、司法書士会に入会している司法書士ではなく、かつ、法定の除外事由がないのに、対象業者の業務に関し、業として、所有権移転等を登記の目的とする登記申請書を提出するなどして登記手続きを代理し、司法書士の業務を行ったことが司法書士法違反であるとして、令和4年7月8日に横浜簡易裁判所から略式命令を受けている。 以上のことは、業務に関し他の法令に違反し、宅地建物取引業者として不適当で あると認められるとして、宅地建物取引業法第65条第1項第3号に該当する。
