当該建設業者は、大阪市内の民間発注工事（以下「本件工事」という。）において、建設業法第16条第１号の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで下請代金の額が同号の政令で定める金額以上となる下請契約を株式会社ＢＵＤＤＹと締結した。 また、当該建設業は、本件工事において、躯体が完成するまで、建設業法第26条第１項又は第２項の規定に違反して、当該工事現場における建設工事の施工の技術上の管理をつかさどる者を配置せず、現場作業に係る実地の総括的技術指導を行わないなど、自ら施工計画の作成、工程管理、品質管理、安全管理、技術的指導等の全ては行わずに本件工事の主たる部分である建築一式工事を株式会社ＢＵＤＤＹに請け負わせており、同法第22条第１項の規定に違反して、その請け負った建設工事を一括して同社に請け負わせた。
