１ 当該建設業者は、令和４年11月、山口県下関市内の太陽光発電システムに係る契約（以下「本契約」という。）を民間の発注者と締結したが、本契約は、当該建設業者が「太陽光発電システムを設備機器施工し」、これを発注者に売り渡すことを約し、同社は代金を工事の進捗に応じて８回に分けて当該建設業者に支払うことを約し、工事完成後発注者が検査を行って契約内容との不適合が発見された場合には、引き渡し前に当該建設業者が補修しなければならないことなどを内容とするものであった。そして、当該建設業者は、令和４年12月に、本契約と一体である土地の売買契約により、発注者に太陽光発電システムの事業地（地目が田のものを除く。）を譲渡し、同年12月頃より、アーバンクラフト株式会社に建設工事を請け負わせて、当該事業地において、造成工事を施工し、令和５年11月頃からは当該太陽光発電設備の設置工事を施工した。とすると、本契約は、売買契約と請負契約の混合契約である製作物供給契約により建設工事の完成をするものであるから、報酬を得て建設工事の完成を目的として締結する契約であり、建設業法第24条の規定により建設工事の請負契約とみなされて同法の規定が適用される。その結果、当該建設業者の契約の相手が発注者となり、当該建設業者はその発注者から直接建設工事を請け負ったこととなる。このように、当該建設業者は、本契約の建設工事において、建設業法第３条第１項の規定に違反して、電気工事業に係る同項の許可を受けないで請負代金が建設業法施行令第１条の２に定める金額以上となる建設工事を発注者から請け負った。 ２ そして、当該建設業者は、工事施工中の令和５年９月29日に電気工事業に係る一般建設業の許可を受けたが、アーバンクラフト株式会社と締結した下請契約に係る下請代金について、工事の施工が進むにつれ、その下請代金の額を増額変更していったため、特定建設業の許可を受ける必要があったところ、同許可を受けずに、本契約の建設工事において、建設業法第16条第１号の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで下請代金の額が同号の政令で定める金額以上となる下請契約をアーバンクラフト株式会社と締結した。また、同工事において、同号に掲げる区分による許可を受けて、同法第26条第２項に規定する監理技術者を工事現場に配置すべきところ、当該許可を受けず、適格な監理技術者を配置しなかった。加えて、同様に、同法第24条の８第１項に規定する施工体制台帳及び同条第４項に規定する施工体系図も作成しなかった。 ３ 当該建設業者は、本契約の建設工事において、上記のとおり適格な技術者を配置せず、当該建設業者が施工計画の作成、工程管理、品質管理、安全管理、技術的指導等の全てを行うことが必要であるところ、その全ては行わずにその請け負った建設工事の主たる部分を一括してアーバンクラフト株式会社に請け負わせており、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して同社に請け負わせた。 ４ 当該建設業者は、本契約の建設工事において、当初はアーバンクラフト株式会社に土地の造成工事のみを請け負わせていたものの、電気工事業の許可を受けた後の令和５年11月頃から、太陽光発電設備の設置などの電気工事を同社に請け負わせて施工させ請負代金５千万円を同社に支払うなど、建設業法第３条第１項の規定に違反して電気工事業に係る同項の許可を受けないで建設業を営む同社と下請契約を締結した。
