丸和工業株式会社が発注者から直接請け負った茨城県猿島郡五霞町における倉庫・事務所増築工事において、令和５年９月２日、一次下請負人の労働者が２階床面の開口部から転落し死亡する事故が発生した。 この件について、労働者の労働災害を防止するため必要な措置を講じなかったとして、同社及び同社の社員１名が令和６年１１月１２日、古河簡易裁判所より労働安全衛生法違反による略式命令を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
