株式会社藤井工務店は、営業所に常勤して専らその職務に従事すべき技術者を、同社が令和元年８月から同年１２月に施工した遠方の港湾しゅんせつ工事に主任技術者として配置しており、当該技術者が営業所に専任しているとは認めがたい状態であったことが、令和３年１１月２４日に受理した事業年度終了報告において確認された。 このことは、建設業法第７条第２号の規定に違反するため、同法第２８条第１項に基づき指示処分とする。
