今泉設備株式会社は、長岡市立中央図書館が発注したトイレ等改修設備工事における元請負人である。同工事の安全衛生管理を統括していた同社代表取締役は、同工事において、令和５年２月６日から同年２月９日の間、第１種酸素欠乏危険作業に係る業務に労働者を就かせるとき、同労働者に対し、厚生労働大臣の定めるところにより、特別教育を行わせなければならないのに、これを行わなかった。 このことから、法人及び同社代表取締役が、労働安全衛生法違反により罰金刑に処され、令和５年10月24日にその刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
