有限会社小松板金及び同社代表取締役は、南秋田郡井川町坂本地内の工事現場において、当該工事の労働者に、建物の屋根を作業床として屋根材の取付作業を行わせるに当たり、同作業床が地上から約５．１６メートルの高さに位置し、墜落により労働者に危険を及ぼすおそれのある場所であることから、危険を防止するために必要な措置を講ずべき業務上の注意義務があったにもかかわらず、これを怠り、同所に囲い、手すり、覆い等を設けず、労働者の労働災害を防止するための必要な措置を講じないまま作業を行わせた過失により、労働者を地上に墜落させ、死亡させた。 これにより、同社及び同社代表取締役が労働安全衛生法違反及び業務上過失致死の罪により、同社については罰金２０万円の略式命令を受け、同社代表取締役については罰金５０万円の略式命令を受け、令和５年１０月１１日までにそれぞれの刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
