株式会社工藤工務店代表者工藤忠行は、令和３年９月１０日、佐倉市の木造２階建の新築工事で労働者に２階の建て方作業を行わせるにあたり、作業中の労働者に危険を及ぼす恐れがあったのに、２階床の開口部に囲い等を設けるなどの危険を防止するための必要な措置を講じなかった。 当該事実に基づき、佐倉簡易裁判所から令和４年５月２４日付け令和４年（い）第１０８号略式命令において、労働安全衛生法違反により、同人が罰金２０万円の刑に処された。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
