（株）増岡組の社員は、令和３年８月５日に広島県立大竹高等学校校舎２７号棟ほか１棟内部改修その他工事（以下、「本件工事」という。）の一般競争入札の予定価格と同額の設計金額を当時広島県建設産業課主査から携帯電話によるメッセージにより受信した。同年８月２６日に謝礼としてスポーツ観戦チケット（スイートルーム入場券１セット１２万２２００円相当）を広島県建設産業課主査に提供した。同年９月９日に電子入札システムにより、予定価格に近接した金額で同社に入札させ、同年１０月１日、本件工事を落札させた。 これにより、（株）増岡組の社員は、刑法第９６条の６第１項（公契約関係競売等妨害罪）及び刑法第１９８条（贈賄）に該当し、令和５年６月２３日に懲役１年６ヶ月（執行猶予３年）の判決を受け、その刑が確定した。 このことが建設業法第２８条第１項第２号に該当するものと認められる。
