１ 施工体制台帳等の不作成等 当該建設業者は、大阪市発注の工事（以下「本件工事」という。）において、その請け負った建設工事を、株式会社渡辺塗装に直接請け負わせていたにもかかわらず、株式会社ケイテックに直接請け負わせたとする虚偽の施工体制台帳及び施工体系図を作成した。 ２ 一括下請負 当該建設業者は、本件工事において、１のとおり、真実の施工体制台帳等を作成しないなど、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して株式会社渡辺塗装に請け負わせた。
