有限会社高橋塗装店が請け負った個人宅塗装工事において、同社の代表取締役は、労働者に高さ３．８メートルの足場の作業床で作業を行わせるに際し、当該作業場所は墜落による労働者に危険を及ぼすおそれがある箇所であったため、高さ８５センチメートル以上の手すり又はこれと同等以上の機能を有する設備及び中さん等を設けなければならなかったにもかかわらず、機械、器具その他の設備による危険を防止するため必要な措置を講じなかったことにより、同社及び同社代表取締役が労働安全衛生法違反により罰金の略式命令を受け、その刑が確定している。 このことが、建設業法第28条第１項第３号に該当すると認められる。
