株式会社五大設備は、令和3年12月25日に、福岡市内の民間工事において、高さ6.24mのわく組み足場にて同社従業員に作業を行わせるにあたり、墜落により同人に危険を及ぼす恐れのある箇所であったにもかかわらず、当該わく組み足場に墜落防止設備を設置しなかったために、同人が墜落し、負傷するに至らしめたことについて、労働安全衛生法違反により、福岡簡易裁判所において罰金20万円の略式命令を受け、令和5年3月18日に刑が確定している。 このことは、建設業法第28条第1項第3号に該当すると認められる。
