株式会社オーミヤは、滋賀県知事から管工事業の一般建設業許可を受けた者であるが、滋賀県内の民間工事において、建設業法第3条第1項に違反して、当該工事の施工に必要な建設業の許可を受けていないにもかかわらず、建設業法施行令第1条の2第1項に定める金額以上となる請負契約を締結した。加えて、建設業法第19条に違反し、当該工事に係る請負契約を締結するにあたり、契約の締結に際して交付すべき書面を当事者に交付していなかった。 このことは、建設業法第28条第3項（同条第1項第2号該当）に該当する。
