(1) 当該建設業者は、東大阪市内の民間発注の工事（以下「本件工事」という。）において、建設業法第16条第２号の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで下請代金の額が同号の政令で定める金額以上となる下請契約を他の建設業者等と締結した。また、本件工事において、同号に掲げる区分による許可を受けて、同法第26条第２項に規定する監理技術者を工事現場に配置すべきところ、当該許可を受けず、適格な監理技術者を配置しなかった。加えて、同様に、同法第24条の８第１項に規定する施工体制台帳及び同条第４項に規定する施工体系図も作成しなかった。（同法第28条第１項第２号該当） (2) 当該建設業者は、本件工事において、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む大谷新建材株式会社と下請契約を締結した（同法第28条第１項第６号該当）。
