有限会社浜口組が発注者から直接請け負った三重県尾鷲市小脇町地内の工事において、下請負人の労働者１名が、崩れ落ちた自然石により足を負傷した。 この件について、労働者に側面に自然石が積み重なった場所で導水管設置作業を行わせるに当たり、落下のおそれのある土石を取り除き、又は擁壁、土止め支保工等を設ける等、土石の落下による労働者の危険を防止するための措置を講じなければならないのに、その措置を講じず、もって土砂等が崩壊するおそれのある場所等に係る危険を防止するため必要な措置を講じなかったとして、同社及び同社社員１名が、尾鷲簡易裁判所から労働安全衛生法違反により、それぞれ罰金２０万円の略式命令を受け、同社は令和５年１０月２８日に、同社社員は令和５年１０月３１日にその刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
