当該建設業者は、兵庫県内の民間発注の工事において、建設業法第３条第１項の規定に違反して電気工事業（本件工事が建築一式工事である場合にあっては建築工事業）に係る同項の許可を受けないで建設業法施行令第１条の２に定める金額以上となる建設工事を請け負い、同法第16条の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで下請代金の額が同号の政令で定める金額以上となる下請契約を株式会社吉信工務店等と締結した。
