令和４年３月14日、東京都世田谷区所在の工事現場において、有限会社鳶内田の労働者が高さ6.8メートルの足場上で足場の組立作業を行っていたところ、地上に落下し死亡した。 足場の組立作業において、労働者に足場上で足場材の緊結及び受け渡しの作業を行わせるに当たり、要求性能墜落制止用器具を安全に取り付けるための設備等を設け、かつ、労働者に使用させる等の墜落防止措置をこうじなければならなかったにもかかわらず、同設備等を設けることなく作業をおこなわせたものである。 以上のことが、労働安全衛生法第20条第1号、第119条第１号及び第122条並びに労働安全衛生規則（昭和47年労働省令第32号）第564条第１項第４号ロに違反し、有限会社鳶内田及び同社取締役が罰金刑に処せられた。 このことが、建設業法第28条第１項第３号に該当する。
