八房建設株式会社の代表取締役山辺元康は、同社の業務に関し、労働基準法の適用除外となる事由がないにもかかわらず、令和６年１０月１日から令和７年３月３１日までの間、奈良県内の工事現場等において、労働者に、１週間について４０時間を超えて時間外労働をさせ、また１週間の各日について、休憩時間を除き１日について８時間を超えて時間外労働をさせたことに関し、労働基準法第３２条第１項及び同条第２項の違反により、令和８年２月２６日に葛城簡易裁判所から罰金２０万円の判決を受け、その刑が確定した。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
