唯一の専任の宅地建物取引士である代表者の宅地建物取引士証が失効してから、新たに宅地建物取引士証の交付を受けるまでの間、専任の宅地建物取引士を2週間以内に設置しなかったことは、法第31条の3第1項及び第3項に違反しており、法第65条第1項に該当する。 また、建物賃貸借契約の媒介の際の賃貸借契約書中、建物付き宅地売買契約の媒介の際の売買契約書中、宅地売買契約の媒介の際の売買契約書中、それぞれに、宅地建物取引士の資格がない者が記名押印を行ったことは、法第37条第3項に違反しており、法第65条第1項に該当する。
