（有）寄棟瓦工事店 代表取締役は、令和３年１月７日、岐阜県揖斐郡大野町大字稲富字洞６９０番地３において廃棄物である紙等在中の段ボール２箱合計約２７．６キログラム及びマットレス１枚約２キログラムを焼却したことに関し、令和３年１１月１２日に大垣簡易裁判所から廃棄物の処理及び清掃に関する法律違反により、罰金３０万円の略式命令を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
