京都土木株式会社は、令和２年２月から令和３年３月に施工した「須知宅地造成工事」及び令和２年11月から令和４年３月に施工した「園部敷地造成他工事」において、それぞれ現場に配置する主任技術者が専任でなければならないにもかかわらず、営業所に常勤して専らその職務に従事すべき営業所の専任技術者を配置していた。 また、京都土木株式会社は、令和２年６月から令和３年６月に施工した「中島共同墓地（解体）復旧他工事」及び令和４年４月から令和５年３月に施工した「園部オート場造成工事」において、それぞれ現場に配置する監理技術者が専任でなければならないにもかかわらず、同時期に施工していた別の公共工事の専任の監理技術者を配置していた。 これらのことは、それぞれ建設業法第26条第３項に違反し、同法第28条第１項の規定により、指示処分の対象となる。
