藤井興業株式会社は、土木工事及び建築工事の請負等を営み、鈴木コーポ建物解体工事を施工する事業者である。同社の代表取締役であるＡは、業務全般を統括管理するとともに、労働者の安全を管理するものである。Ａは、令和４年10月３日、飯田市座光寺の工事現場において、労働者Ｂほか１名に、高さ５メートル以上のコンクリート造建築物で作業を行わせるに当たり、厚生労働省令で定めるところによりコンクリート造の工作物の解体等作業主任者として労働者Ｃを選任したが、同人に被災者の要求性能墜落制止用器具の使用状況を監視させず、解体等作業主任者に当該作業に従事する労働者の指揮その他厚生労働省令で定める事項を行わせなかった。 このことにより、藤井興業株式会社及び代表取締役Ａは労働安全衛生法違反により各々罰金20万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
