１ 翼工建株式会社は，民間工事において，特定建設業の許可を有していないにも関わらず，建設業法第３条第１項第２号の政令で定める金額(7,000万円)以上となる下請契約を締結した。 このことは，同法第16条第１号の規定に違反し，同法第28条第１項に該当する。 ２ 翼工建株式会社は，民間工事において，契約締結に際し，建設業法第19条第１項に定める契約内容となる一定の重要な事項を書面に記載し，相互に交付しなかった。 このことは，建設業法第28条第１項に該当する。
