株式会社丸本組は，同社が元請として請け負った石巻市内の防潮堤工事の現場において，下請負人の作業員に，高さ約5ｍに位置する作業場所で天端の仕上げ作業を行わせるに当たり，足場が強風であおられて作業員が墜落するおそれがあったにもかかわらず，丈夫な構造を有しない 足場を使用させ，もって作業員の労働災害を防止するため必要な措置を講じず，強風により足場が倒壊し作業員が墜落し死亡した。 このことにより，令和3年10月21日に石巻簡易裁判所から，同社が労働安全衛生法（昭和47年法律第57号。以下「安衛法」という。）違反並びに同社の現場代理人が安衛法違反及び業務上過失致死罪によりそれぞれ罰金刑の略式命令を受け，いずれもその刑が確定した。 このことは，法第28条第1項第3号に該当する。
