当該建設業者は、大阪府高槻市中川町５番８号に本店を置き、総合建設業を営む事業者であるが、当該建設業者の本社所属の労働者で、当該建設業者が請け負った大阪府大阪市浪速区所在のホテル新築工事の現場代理人として、同工事現場における施工管理及び安全管理を統括するものが、当該建設業者の業務に関し、令和３年７月14日、同工事現場において、自らをして鉄筋コンクリート造９階建て同現場屋上を作業床として作業を行わせるに当たり、同屋上は墜落により労働者に危険を及ぼすおそれがあり、かつ、同屋上に囲い、手すりを設けることが容易であったのに、これを設けず、もって、労働者が墜落するおそれのある場所に係る危険を防止するための必要な措置を講じなかった。 このことで、当該建設業者は、労働安全衛生法（昭和47年法律第57号）違反により、罰金30万円の刑に処せられ、令和４年5月27日にその刑が確定した。
