Dayo Painting Industry Co., Ltd. (hereinafter "the company") and its employees engaged in waterproof sheet installation work at a private renovation site in Akaiwa City, Okayama Prefecture. During the work on the roof of a building, a worker fell from the edge of the roof, was transported to a hospital, and subsequently died. The company and its employees, while aware that they had not installed barriers or guardrails at the edge of the roof, nor set up a safety line, and that workers were not using safety harnesses fixed to a safety line, failed to exercise the duty of care to prevent occupational accidents and allowed the worker to perform the work under these conditions. On February 1, 2023, they each received a summary order of a fine from the Okayama Summary Court for violations of the Act on Securing, etc. of Safe Working Conditions for Workers and for professional negligence resulting in death, and the penalties were finalized. 大陽塗装工業株式会社（以下「同社」という。）の４次下請けの労働者が、岡山県赤磐市の民間改修工事現場において、棟の屋上にて防水シート設置の作業中、屋上の端から墜落し、病院へ搬送されたが、その後死亡した。 同社及び同社の従業員は、当該工事現場の防水シート設置作業に従事させるに当たり、棟屋上の端部に囲い等を設けておらず、かつ親綱も設置しておらず、労働者が親綱に固定した安全帯を使用しない状態で作業に従事していることを認識していながら、労働災害を未然に防止すべき業務上の注意義務を怠り、労働者に前記作業に従事させた。 この件について、同社及び同社の従業員は令和５年２月１日付けで労働安全衛生法違反及び業務上過失致死罪により岡山簡易裁判所からそれぞれ罰金刑の略式命令を受け、その刑が確定した。 このことが、建設業法第28条第１項第３号に該当すると認められる。
