当該建設業者は、大阪府枚方土木事務所発注で他の建設業者から請け負った工事において、主任技術者が常時継続的に本件工事現場に係る職務にのみ従事せず、また、交野市内の民間工事の主任技術者及び現場代理人を兼任しており、建設業法第26条第３項の規定に違反して、専任の者でない同人を主任技術者として本件工事現場に配置した。 また、当該民間工事において、建設業法第26条第３項の規定に違反して、専任の者でない当該者を主任技術者として当該工事現場に配置した。
