上武工業（株）の代表取締役（当時）は、前橋市が令和２年６月２６日に執行した「粕川地区配水管布設替工事（施道第２号）」に係る指名競争入札に関し、同市副市長（当時）から同入札に関する秘密事項である同工事の予定価格の教示を受け、貴社に同予定価格に近接する金額で入札させて同案件を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為を行った。これにより、前橋地方裁判所から令和５年３月１５日に懲役１年(執行猶予３年) の判決を受け、同月３０日にその刑が確定した。このことが、建設業法第２８条第１項第２号及び第３号に該当し、同条第３項に基づき営業停止処分とする。
