当該建設業者は、大阪市内の民間発注工事（以下「本件工事」という。）において、本件工事の２次下請負人である株式会社AY建設の従業員を、監理技術者証を偽造して、工事現場に配置するなど、建設業法第26条第２項の規定に違反して、直接的かつ恒常的な雇用関係のない資格要件を満たさない者を監理技術者として工事現場に配置した。 そして、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して株式会社第一コンストラクションに請け負わせた。 また、本件工事において、３次下請負人の一部を施工体制台帳及び施工体系図に記載せず、建設業法第24条の８第１項及び第４項の規定に違反して、虚偽の施工体制台帳及び施工体系図を作成した。
