被処分者は、免許された日から３月以内に法第２５条第４項の規定による届出をしなかった。また、同条第６項の規定に基づき、令和６年８月１５日付けで営業保証金を供託するよう催告したが、期日までに供託した旨の届出をしなかった。 さらに、被処分者は、催告を受けた後に営業保証金の供託の届出をしないまま事業を開始し、取引の相手方に損害を発生させた。 このことは、法第２５条第５項の違反し、法第６５条第２項第２号に該当する上、法第６６条第１項第９号前段に該当する。
