岩城建設株式会社の前代表取締役は、上島町が令和２年８月27日に入札を執行した「長江港浮桟橋改修工事」に関し、また、同社の前取締役は、同町が令和３年５月26日に入札を執行した「長江港浮桟橋塗装除去工事」に関し、それぞれ当時の町職員から秘密事項である予定価格やそれと同額である工事価格などの教示を受けて、同社にそれらの工事を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為をしたとして、公契約関係競売入札妨害の罪により、懲役１年（執行猶予３年）の判決を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
