１ 契約の内容・経緯等 当該建設業者は、訪問販売により、発注者と建設工事請負契約を締結し、兵庫県伊丹市内の民間発注の改修工事（「（以下「本件工事」という。）を請け負った。本件工事は、①仮設工事（足場組立等）、②解体工事（サッシ、内部及び設備解体撤去等）、③建具工事、④内部間仕切、造作工事（クロス貼り75㎡（軽天、ボード下地）、床CF貼70㎡（鋼製、合板下地）、タイル貼等）、⑤住宅設備工事（バス、台所、洗面台、トイレ）、⑥補修工事（外部サッシ下地、防水コーキング他、フェンス）、⑦給排水工事、⑧電気工事（オール電化及び照明器具を含む。）、⑨エコキュート工事及び⑩外壁、外塗装工事（屋根防水を含む。）から構成される建設工事であり、店舗であった１階部分を住宅に改築することを主たる目的とするものであった。当該建設業者は、本件工事のうち、上記②から⑧までの建設工事を、建設業の許可を受けていないAに請け負わせた。当該建設業者は、Aとは基本契約を締結しており、当該建設業者が請け負った建設工事の全部又は一部を同者に一括して施工させることとしていた。そして、本件工事においては、発注者に対して、Aに当該建設業者の所属である旨の名刺を持たせた上で、同氏が当該建設業者としての本件工事の工事責任者である旨説明していた。 ２ 工事の瑕疵について 当該建設業者から現場監理及び工事の施工を任されたAが、工事を着工し、当該建設業者の主任技術者から工事現場における技術的指導がないまま本件工事を施工した結果、工期末間際に、発注者側からの指摘により、次のような瑕疵が発覚した。 (1)床基礎工事 床の基礎となる鋼材の間隔が不均等で、その溶接も不十分な箇所があり、水平方向のレベルも不均一であった。また、床の端の鋼材の端の支えがない箇所があり、専用の器具を使わずに鋼材の継ぎ足しがされているものもあった。さらに、鋼材の支柱部分と地面との間に隙間がある箇所が多数あり、その隙間に廃材がつめられているものもあった。この問題が発覚後に補修を行った。 (2)支柱基礎コンクリート工事 基礎コンクリートを床下面から大きな空間ができるまで不必要に斫り、ところによっては基礎コンクリートの中のアンカーボルト座面・座金下まで斫ってそれを剝きだしにしてその軸力が抜けた状態とし、横揺れ耐震強度を低下させた。鉄骨棚の溶接切断作業中、支柱の角付近に誤って穴を開け、横揺れ耐震強度を低下させる可能性のある状態にした。上記の剝きだしたアンカーボルト・ナットの防錆処理をしなかった。 ３ 一括下請負 １及び２のとおり、当該建設業者は、本件工事において、その請け負った建設工事の主たる部分を一括してAに請け負わせて、Aを当該建設業者の施工管理責任者（工事監理者）として配置し、当該建設業者としては適格な主任技術者による現場作業に係る実地の総括的技術指導を行わないなど、施工計画の作成、工程管理、品質管理、安全管理、技術的指導、注文者等との協議・調整の全てを当該建設業者が行う必要があるところ、その全ては行っていなかった。 すなわち、当該建設業者は、本件工事において、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括してAに請け負わせた。 ４ 粗雑工事 １のとおりの契約及びその経緯のもと、当該建設業者が、２のとおり、本件工事において、下請負人に対する適切な技術的指導を行わないなど、粗雑工事を行ったことにより、工事目的物に重大な瑕疵が生じた。
