平成２５年１０月３０日から令和７年１２月１５日までの間、株式会社葛城工務店の営業所技術者として登録された者が、宅地建物取引業者免許を有する他社において、専任を要する宅地建物取引士に就任していた事実が認められた。 当該期間、その者は株式会社葛城工務店での職務に専ら従事していたとは認められないことから、少なくとも舗装工事、塗装工事、防水工事、内装仕上工事、水道施設工事の各許可業種について、建設業法（昭和２４年法律第１００号）第７条第２号に違反すると認められる。 このことは、建設業法第２８条第１項本文に該当すると認められる。
