株式会社中山建設の元代表取締役は、令和４年７月中旬および同年９月下旬頃に、当時那須烏山市職員であった者に対し、同市が発注する道路の維持管理業務委託に関し、同社が有利かつ便宜な取り計らいを受けたことに対する謝礼及び今後も同様の取り計らいを受けたいとの趣旨の下に賄賂を供与したとして、令和６年３月18日、贈賄罪により宇都宮簡易裁判所において罰金20万円に処する旨の略式命令を受け、これが確定した。 このことは、建設業法第28条第１項第２号及び第３号の規定に該当するものと認められる。
