１ 監理技術者の不設置 当該建設業者は、大阪市発注の工事（以下「本件工事」という。）において、株式会社ケイテックとその請負代金が政令で定める金額を超える下請契約を締結しているため、少なくとも当該下請契約の契約日から監理技術者を配置すべきところ、「１級建築施工管理技士」の資格を有せず、及び監理技術者資格者証の交付を受けていないため、監理技術者としての資格要件を満たさないＡ氏を同日から同資格の合格発表日の前日まで及び同日から同資格に係る監理技術者資格者証の交付を受ける日の前日までの間、建設業法第26条第２項及び第５項の規定に違反して、工事現場に専任の主任技術者として配置した。 ２ 施工体制台帳等の不作成等 当該建設業者は、本件工事において、その請け負った建設工事を、株式会社ケイテックに直接請け負わせていたにもかかわらず、建設業法第24条の８第１項及び第４項の規定に違反して、その請け負った建設工事を株式会社ケイテックには直接請け負わせてないとする虚偽の施工体制台帳及び施工体系図を作成した。 ３ 一括下請負 当該建設業者は、本件工事において、１のとおり、適格な監理技術者を配置しないなど、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括して株式会社ケイテックに請け負わせた。
