株式会社成田産業の代表取締役である成田 政已は、法定の除外事由がないのに、平成３０年７月１日に同社資材置き場において、廃棄物であるコルゲート管等約１０立方メートルを焼却したものである。 当該事実に基づき、木更津簡易裁判所から平成３０年１２月１８日付け平成３０４年（い）第３０１号略式命令において、廃棄物の処理及び清掃に関する法律違反により、同人が罰金３０万円の刑に処された。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
