大成興業株式会社は、令和７年１月に請け負った防水工事において、建設業法第３条第１項の許可を受けないで建設業を営む者と、軽微でない工事についての下請契約を締結した。また、同法第16条第１項に違反し、特定建設業の許可を受けないで、下請代金の額が同法第３条第１項第２号の政令で定める金額以上となる下請契約を締結した。さらに、同法第15条第２号に規定する営業所の専任技術者である者を、同法第26条第３項の規定に違反して、専任を要する主任技術者として配置した。 このことは、建設業法第28条第１項本文、同条第１項第２号及び同条第１項第６号に該当する。
