松本装飾株式会社は、令和元年10月5日の管工事業の専任技術者の退社以降、受注した管工事については、管工事業の許可要件を欠いているにも関わらず、建設業法第3条第1項の政令で定める軽微な建設工事の範囲を超える工事を請け負っていたことは、同法第3条第1項に違反し、同法第28条第2項第2号に該当する。 さらに、令和元年10月5日の管工事業の専任技術者の退社以降、請け負った管工事において、管工事業の資格要件を満たさない者を主任技術者として配置していたことは、同法第26条第1項に違反し、同法第28条第1項本文に該当する。
