有限会社岡田組は、香川県高松市内の西部バイパス幹線工事の下請業者であったが、令和２年５月２７日にこの工事現場で発生した労働者の災害について、４日以上の休業を要した災害であることを認識しながら、直近上位請負会社の工事担当課長と共謀し、高松労働基準監督署に労働者死傷病報告書を提出しなかった。 このことにより、高松簡易裁判所から、同社及び同社の代表取締役が労働安全 衛生法違反で罰金刑の略式命令を受け、それぞれその刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められるため、同 法第２８条第１項に基づき指示処分とする。
