当該建設業者は、東大阪市内の民間工事（以下「本件工事」という。）において、他の建設業者Aの代表取締役を監理技術者として工事現場に配置するなど、建設業法第26条第1項及び第２項の規定に違反して、資格要件を満たさない直接的かつ恒常的な雇用関係のない者を監理技術者として工事現場に配置した。 また、本件工事において、建設業法第16条の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで下請代金の額が同号の政令で定める金額以上となる下請契約を他の建設業者B等と締結した。 また、本件工事において、建設業法第22条第1項の規定に違反して、その請け負った建設工事を一括して他の建設業者Bに請け負わせた。
