株式会社佐藤渡辺の元石川営業所長は、他の者と共謀の上、福島県石川郡石川町が令和４年９月２６日に執行を予定していた「町道３０４２号線道路改良工事」及び「町道２２２号線道路改良工事」の指名競争入札に関し、公正な価格を害する目的で、令和４年９月７日頃から令和４年９月２５日頃までの間に談合した。この結果、刑法第９６条の６第２項の規定により、令和６年１０月２３日に郡山簡易裁判所において罰金４０万円の略式命令を受け、その刑が確定している。 このことが建設業法第２８条第１項第２号及び第３号に該当すると認められる。
