土地売買契約及び建築工事請負契約における重要事項説明書について、媒介業者と共同して虚偽の記載を行った。このことは、法第35条第１項第２号の規定に違反しており、法第65条第１項に該当する。 また、土地売買契約及び建築工事請負契約書を媒介業者と共同で作成して買主と契約を締結した後、同土地に関して買主が金融機関から融資を受けるため、先の契約を解約することなく土地建物売買契約書を媒介業者と共同で作成し、買主と契約を締結した。このことは法第65条第１項第２号の規定に該当する。
