富士ロードサービス株式会社の役員は、同社の業務に関し、令和５年11月14日、伊東市松原湯端町のマンホール改築工事の現場において、労働者にマンホール内の清掃をする第二種酸素欠乏危険作業を行わせるに当たり、作業を開始する前に、当該作業場所の空気中の酸素及び硫化水素の濃度を測定しなければならないのに、濃度の測定をせずに、労働者に作業を行わせた。 この件について、熱海簡易裁判所は令和６年７月９日に同社及び同社の役員に対し、労働安全衛生法違反に基づきそれぞれ罰金30万円の略式命令を行い、これが確定した。 このことは、建設業法第28条第１項第３号に該当するものと認められる。
