赤井田造園土木株式会社は、本県発注の道路橋りょう維持（災防）工事（災害防除）（工事番号：２１－４１３２２－００４７）（以下「対象工事１」という。）及び道路橋りょう維持（災防）工事（災害防除）（工事番号：２１－４１３２２－００５３）(以下「対象工事２」)において、対象工事１に監理技術者を配置しなければならなくなったにもかかわらず、同一の者に対象工事１の監理技術者及び対象工事２の主任技術者を兼務させていた。 このことは、建設業法（昭和２４年法律第１００号）第２６条第３項に違反し、同法第２８条第１項本文に該当する。
