（有）糸川重機は、島根県が発注した「（主）松江鹿島美保関線 県単災害復旧工事（４災４号）」において、車両系建設機械であるドラグ・ショベルを用いて重機足場を構築するための大型土のうの設置作業を行うに当たり、同機械に接触することにより労働者に危険が生ずるおそれがあったのに、誘導者を配置せず、労働者を同機械の旋回範囲内に立ち入らせ、その結果、労働者が同機械と土工用防護柵に挟まれ死亡した。 同社及び同社の従業員は、同機械による危険を防止するための必要な措置を講じなかったとして、令和６年１２月１０日付けで松江区検察庁から起訴され、令和６年１２月１３日付けで松江簡易裁判所より罰金刑の略式命令を受けた。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
