協進建設株式会社は、令和４年３月１１日千葉県千葉市稲毛区稲毛台町での店舗併用住宅改修 工事において、下請負人の労働者に架設通路を使用させるにあたり、法定の除外事由がないのに、墜落により労働者に危険を及ぼすおそれがあったにもかかわらず、労働者の労働災害を防止するため必要な措置を講じなかった。当該事実に基づき、千葉簡易裁判所から令和４年（い）第３０８９８号略式命令において、労働安全衛生法違反により、罰金２０万円に処せられた。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
