(1) 当該建設業者は、大阪市発注の工事において、建設業法第26条第３項の規定に違反して、他の工事現場に専任の主任技術者として配置されていたＡ氏を専任の主任技術者として配置した。 (2) 当該建設業者は、経営規模等評価の申請において、建設業法第27条の26第２項から第４項までの規定に違反して、Ａ氏が他社に雇用されて他の工事現場の現場代理人となっていたにもかかわらず、同氏を「技術職員名簿」に記載をした。
