株式会社苫小牧清掃社は、厚真町所在の苫東厚真発電所１号機の工事現場において、石炭灰が堆積したホッパー吸引作業を行わせるに当たり、石炭灰に埋没することにより労働者に危険を及ぼすおそれがあるにも関わらず、危険防止の措置を講じないまま作業を行わせた。 このことにより、労働安全衛生法違反で起訴され、法人が苫小牧簡易裁判所において略式命令を受け、令和６年４月１９日に罰金刑が確定した。 このことは、建設業法第２８条第１項第３号に該当するものである。
